1. Despre platformă

Licitatii24 (licitatii24.com) este o platformă online pe care utilizatorii își vând bunurile prin licitație. Platforma este operată de [denumirea operatorului, de completat], IDNO [de completat], cu sediul în [adresa, de completat]. Contact: [email protected].

Platforma este un intermediar tehnic. Nu este proprietarul bunurilor, nu este parte în contractul de vânzare dintre utilizatori și nu primește sau reține plata bunurilor.

2. Cine poate folosi platforma

• Persoane de cel puțin 18 ani, cu capacitate deplină de exercițiu, și persoane juridice.
• Un singur cont de persoană. Datele trebuie să fie reale și actuale.
• Contul se activează după confirmarea adresei de email.
• Răspunzi pentru tot ce se face din contul tău și pentru păstrarea parolei.

3. Reguli pentru vânzători

• Vinzi doar bunuri care îți aparțin sau pe care ai dreptul să le vinzi.
• Descrii bunul corect și declari defectele cunoscute. Fotografiile trebuie să fie ale bunului respectiv.
• Dacă licitația se încheie cu oferte și prețul de rezervă e atins, ești obligat să vinzi celui mai bun ofertant, la prețul final.
• Un anunț care are oferte nu mai poate fi retras.
• Nu licitezi la propriile anunțuri, nici direct, nici prin alte conturi sau persoane.

4. Reguli pentru cumpărători

• Oferta este un angajament ferm de cumpărare și nu poate fi retrasă.
• Dacă ai câștigat, achiți comisionul platformei în 48 de ore, apoi plătești bunul direct vânzătorului, la predare.
• Dacă nu achiți comisionul la termen, lotul trece la următorul ofertant, primești un avertisment, iar la al doilea contul este blocat.
• Verifică bunul înainte de plată.

5. Bunuri interzise

Nu pot fi puse la licitație: arme, muniție și explozibili; droguri și substanțe interzise; medicamente eliberate cu rețetă; bunuri furate, contrafăcute sau care încalcă drepturi de autor; acte de identitate și documente oficiale; date personale ale altor persoane; animale din specii protejate; orice bun a cărui vânzare este interzisă de legea Republicii Moldova. Anunțurile care încalcă regula sunt eliminate, iar contul poate fi blocat.

6. Comisioane

• Publicarea anunțurilor este gratuită.
• Câștigătorul plătește platformei un comision de 5% din prețul final, minimum 20 lei și maximum 500 lei.
• Comisionul se achită prin transfer bancar, cu codul de referință afișat în cont.
• Comisionul nu se restituie dacă tranzacția nu are loc din vina cumpărătorului.
• Modificările de comision se anunță cu cel puțin 15 zile înainte și nu se aplică licitațiilor deja începute.

7. Răspunderea platformei

• Nu verificăm bunurile și nu garantăm existența, starea, calitatea sau legalitatea lor. Răspunderea aparține vânzătorului.
• Nu garantăm că utilizatorii își respectă obligațiile. Blocăm conturile care încalcă regulile.
• Nu răspundem pentru pierderi cauzate de întreruperi tehnice, în măsura permisă de lege.
• Drepturile pe care legea ți le dă ca consumator nu sunt limitate de acești termeni.

8. Licitații oficiale

Anunțurile din secțiunea „Licitații oficiale” sunt preluate din surse publice, în scop de informare. Participarea se face la organizator. Nu garantăm că informațiile sunt complete sau actuale. Anunțul original prevalează întotdeauna.

9. Conținutul publicat de tine

Rămâi titularul textelor și fotografiilor tale. Ne dai dreptul, neexclusiv și gratuit, de a le afișa pe platformă cât timp anunțul există. Garantezi că ai dreptul să le publici.

10. Suspendarea și închiderea contului

Putem suspenda sau închide un cont care încalcă acești termeni, legea sau drepturile altora. Îți poți șterge singur contul din Contul meu, Profil, cu excepția situațiilor în care ai obligații în curs.

11. Date personale

Prelucrarea datelor este descrisă în Politica de confidențialitate.

12. Legea aplicabilă și litigii

Acești termeni sunt guvernați de legea Republicii Moldova. Neînțelegerile se rezolvă întâi pe cale amiabilă, la adresa de contact. Dacă nu se ajunge la o înțelegere, sunt competente instanțele din Republica Moldova. Consumatorii se pot adresa și Inspectoratului de Stat pentru Supravegherea Produselor Nealimentare și Protecția Consumatorilor.

13. Modificarea termenilor

Versiunea nouă se publică aici, cu data. Pentru schimbări importante te anunțăm pe email cu cel puțin 15 zile înainte. Dacă nu ești de acord, îți poți șterge contul.

The platform is a technical intermediary. It does not own the items, is not a party to the sale contract between users and does not receive or hold payment for items.

2. Who can use the platform

• People aged 18 or over with full legal capacity, and legal entities.
• One account per person. Details must be real and current.
• The account is activated after the email address is confirmed.
• You are responsible for everything done from your account and for keeping your password safe.

3. Rules for sellers

• You sell only items you own or are entitled to sell.
• You describe the item accurately and declare known defects. Photos must show the actual item.
• If the auction ends with bids and the reserve price is met, you must sell to the highest bidder at the final price.
• A listing that has bids can no longer be withdrawn.
• You do not bid on your own listings, directly or through other accounts or people.

4. Rules for buyers

• A bid is a firm commitment to buy and cannot be withdrawn.
• If you win, you pay the platform fee within 48 hours, then pay for the item directly to the seller on handover.
• If you do not pay the fee on time, the lot passes to the next bidder, you get a warning, and on the second one the account is blocked.
• Inspect the item before paying.

5. Prohibited items

The following may not be auctioned: weapons, ammunition and explosives; drugs and banned substances; prescription medicines; stolen or counterfeit goods or goods infringing copyright; identity documents and official papers; other people's personal data; animals of protected species; any item whose sale is forbidden by the law of the Republic of Moldova. Listings breaking this rule are removed and the account may be blocked.

6. Fees

• Publishing listings is free.
• The winner pays the platform a fee of 5% of the final price, minimum 20 lei and maximum 500 lei.
• The fee is paid by bank transfer, with the reference code shown in the account.
• The fee is not refunded if the transaction fails through the buyer's fault.
• Fee changes are announced at least 15 days in advance and do not apply to auctions already started.

7. Liability of the platform

• We do not inspect items and do not guarantee their existence, condition, quality or legality. The seller is responsible.
• We do not guarantee that users meet their obligations. We block accounts that break the rules.
• We are not liable for losses caused by technical interruptions, to the extent the law allows.
• The rights the law gives you as a consumer are not limited by these terms.

8. Official auctions

Notices in the "Official auctions" section are taken from public sources, for information. You take part with the organiser. We do not guarantee that the information is complete or current. The original notice always prevails.

9. Content you publish

You remain the owner of your texts and photos. You give us a non-exclusive, free right to display them on the platform while the listing exists. You warrant that you are entitled to publish them.

10. Suspending and closing an account

We may suspend or close an account that breaks these terms, the law or the rights of others. You can delete your own account from My account, Profile, except while you have outstanding obligations.

11. Personal data

Data processing is described in the Privacy policy.

12. Governing law and disputes

These terms are governed by the law of the Republic of Moldova. Disputes are first settled amicably, at the contact address. Failing that, the courts of the Republic of Moldova have jurisdiction. Consumers may also turn to the State Inspectorate for the Supervision of Non-Food Products and Consumer Protection.

13. Changes to the terms

The new version is published here, with its date. For important changes we notify you by email at least 15 days in advance. If you disagree, you can delete your account.

Платформа является техническим посредником. Она не владеет лотами, не является стороной договора купли-продажи между пользователями и не получает и не удерживает оплату за лоты.

2. Кто может пользоваться платформой

• Лица не моложе 18 лет, обладающие полной дееспособностью, и юридические лица.
• Один аккаунт на человека. Данные должны быть достоверными и актуальными.
• Аккаунт активируется после подтверждения адреса email.
• Вы отвечаете за всё, что делается из вашего аккаунта, и за сохранность пароля.

3. Правила для продавцов

• Вы продаёте только то, что принадлежит вам или что вы вправе продавать.
• Вы описываете лот достоверно и указываете известные дефекты. На фотографиях должен быть именно этот лот.
• Если аукцион завершился со ставками и резервная цена достигнута, вы обязаны продать лот победителю по итоговой цене.
• Объявление, на которое есть ставки, снять уже нельзя.
• Вы не делаете ставки на свои объявления ни напрямую, ни через другие аккаунты или лиц.

4. Правила для покупателей

• Ставка — это твёрдое обязательство купить, отозвать её нельзя.
• Если вы выиграли, вы оплачиваете комиссию платформы в течение 48 часов, затем платите за лот напрямую продавцу при передаче.
• Если комиссия не оплачена вовремя, лот переходит к следующему участнику, вы получаете предупреждение, а после второго аккаунт блокируется.
• Проверяйте лот перед оплатой.

5. Запрещённые лоты

На аукцион нельзя выставлять: оружие, боеприпасы и взрывчатые вещества; наркотики и запрещённые вещества; рецептурные лекарства; краденые и контрафактные товары, а также товары, нарушающие авторские права; удостоверения личности и официальные документы; персональные данные других лиц; животных охраняемых видов; любые вещи, продажа которых запрещена законом Республики Молдова. Такие объявления удаляются, а аккаунт может быть заблокирован.

6. Комиссии

• Публикация объявлений бесплатна.
• Победитель платит платформе комиссию 5% от итоговой цены, минимум 20 лей и максимум 500 лей.
• Комиссия оплачивается банковским переводом с кодом, указанным в аккаунте.
• Комиссия не возвращается, если сделка не состоялась по вине покупателя.
• Об изменении комиссии сообщается не менее чем за 15 дней, и оно не применяется к уже начатым аукционам.

7. Ответственность платформы

• Мы не проверяем лоты и не гарантируем их наличие, состояние, качество или законность. Ответственность несёт продавец.
• Мы не гарантируем, что пользователи выполнят свои обязательства. Мы блокируем аккаунты нарушителей.
• Мы не отвечаем за убытки из-за технических перебоев в пределах, допустимых законом.
• Права, которые закон даёт вам как потребителю, этими условиями не ограничиваются.

8. Официальные торги

Объявления в разделе «Официальные торги» взяты из открытых источников в информационных целях. Участие происходит у организатора. Мы не гарантируем полноту и актуальность информации. Приоритет всегда имеет оригинальное объявление.

9. Публикуемый вами контент

Вы остаётесь правообладателем своих текстов и фотографий. Вы даёте нам неисключительное бесплатное право показывать их на платформе, пока объявление существует. Вы гарантируете, что вправе их публиковать.

10. Приостановка и закрытие аккаунта

Мы можем приостановить или закрыть аккаунт, нарушающий эти условия, закон или права других лиц. Вы можете сами удалить аккаунт в разделе «Мой аккаунт», «Профиль», кроме случаев, когда у вас есть незавершённые обязательства.

11. Персональные данные

Обработка данных описана в Политике конфиденциальности.

12. Применимое право и споры

Эти условия регулируются правом Республики Молдова. Споры сначала решаются мирным путём по контактному адресу. Если договориться не удалось, компетентны суды Республики Молдова. Потребители также могут обратиться в Государственную инспекцию по надзору за непродовольственными товарами и защите прав потребителей.

13. Изменение условий

Новая версия публикуется здесь с датой. О важных изменениях мы сообщаем по email не менее чем за 15 дней. Если вы не согласны, вы можете удалить аккаунт.
